beef jerky

You can choose to be a(n) beef jerky :

  • Sole Proprietor,
  • LLC,
  • Corporation or
  • Partnership.
After you decide and select your business entity, you need licensing.

Greenville Business Tax Registration ( beef jerkyBusiness License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) beef jerky business using a DBA Doing Business As Trade Name in Greenville County , i.e., starting businesses using a company name other than the legal (given name) owner's name, need a(n) DBA Doing Business As Trade Name Registration.   For example, you start a(n) beef jerky business and you call it "Ultra beef jerky Co". You will need to file a trade firm name for it.

Also, keep in mind that in beef jerky though, a business license and a DBA is necessary for most businesses but if your business sells any taxable items, you will need a sales tax ID number.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states). You will need it if you sell or want to buy wholesale any beef jerky related items, such as food, materials, or merchandise.
Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

If you are thinking of hiring help, you will need a state employer ID and an IRS number employer ID. I.e., a SC Federal Tax Id Number ($29) and a(n) SC  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Greenville, Incorporate in SC  or  form a(n) SC LLC
.

If you will set up a corporation or form an LLC, you will not have to file a DBA (Doing Business As) unless your corproration or LLC name will be different that the busienss name you will trade under. Businesses that use the full legal name of the owner as a business name do not need to register an assumed business name. So, for example, your name is "John X Doe" and you use that as a business name.

If you do form an Other llc or incorporate (about $49 plus state fees for most states) your beef jerky business instead of just filing a fictitious business name (dba), it will help you avoid legal and financial personal liability arising out of business transactions and you will not have to register the Greenville business name. Instead of filing a Greenville County fictitious business name (our service fee includes dba business name filing and legal paper publication) you can elect to incorporate in   or form an SC LLC (starts @ $49 plus state fee for most states & includes bylaws and LLC operating agreement)..

Im Selling Beef Jerky For Someone Else: what licenses does a beef jerky business need in Greenville, SC?

Strips of seasoned meat on drying racks, a peppery smell and bags lined up for labeling.

Short answer: Im Selling Beef Jerky For Someone Else: a beef jerky business in Greenville typically needs the Retail License, a federal tax ID number (EIN) and a local business license, with an LLC and a DBA if you use a trade name.

Buying and selling wholesale in South Carolina

The South Carolina version of the seller's permit is the Retail License. When you buy inventory to resell, the paperwork is a Form ST-8A Resale Certificate. A retail license is required for retail sellers; a business making only wholesale sales may not need one. South Carolina also accepts the multistate uniform certificate in place of its ST-8A form if it contains the same information. Jerky bought from a producer for resale can be purchased tax-free with a resale certificate, as can ingredients and packaging used if you make it yourself.

Your Greenville filing checklist

  1. LLC – suppliers and banks take an LLC more seriously than a name on a napkin
  2. Trade name (DBA) – South Carolina has no general statewide DBA filing; some cities or counties keep their own trade name records, and an LLC under its exact name needs none
  3. Federal tax ID number (EIN) – keeps your Social Security number off W-9 forms and supplier paperwork
  4. Retail License – required before the first taxable sale, including online, flea market and craft fair sales
  5. Form ST-8A Resale Certificate – covers goods you resell, not supplies you use up
  6. State employer ID – for state income tax withholding and unemployment insurance once you hire
  7. Greenville business license – renewed every year; inspectors may visit if you sell food or work with the public
  8. Meat handling permit
  9. Food handler card

If you sell across state lines

  • Arizona: the Transaction Privilege Tax (TPT) license. Arizona's TPT is a tax on the seller's privilege of doing business, not a tax on the buyer.
  • North Carolina: the Certificate of Registration (sales and use tax). North Carolina lets registered wholesale-only merchants opt out of filing sales and use tax returns.
  • Oregon: No statewide sales tax, so no seller's permit; out-of-state suppliers may still ask for documentation such as a multistate exemption certificate.

Tip: Selling someone else's jerky still means labeling and handling rules. Learn them before the first bag leaves the kitchen.
