IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.

Filing a DBA is not required if you will set up an LLC or form a Corporation. If you will do business under your first and last legal name you will not need to get a fictitious business name.

If you do form an Services llc or incorporate (about $49 plus state fees for most states) your JEWELRY, Buying And Hope To Sell business instead of just filing a fictitious business name (dba), that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Augusta business name. In lieu of recording a Columbia County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in GA or form an GA LLC (starts @ $49 plus state fee for most states & includes bylaws for the corporation and Limited Liability operating agreement for the LLC that is required to open a business bank account). .

Wholesale License In Augusta Georgia: which permit lets a jewelry reselling business in Augusta, GA buy wholesale?

Short answer: Wholesale License In Augusta Georgia: in Georgia, what most people call a wholesale license is the sales and use tax number (Certificate of Registration). With it, and a Form ST-5 Sales Tax Certificate of Exemption for your suppliers, a jewelry reselling business can buy inventory for resale without paying sales tax up front.

Buying and selling wholesale in Georgia

The Georgia version of the seller's permit is the sales and use tax number (Certificate of Registration). To buy for resale without paying sales tax, you give the supplier a Form ST-5 Sales Tax Certificate of Exemption. Suppliers generally accept a resale certificate only from a buyer registered for sales tax, so even a business that mostly buys and sells wholesale usually registers. Buyers using Form ST-5 generally need a Georgia sales tax number when registration applies to them. Georgia's ST-5 certificate covers resale and many other exemptions; the buyer marks the reason and lists its registration number. Inventory of jewelry bought for resale bought for resale is exempt from sales tax at purchase when the buyer gives the supplier a resale certificate, while supplies used in the business stay taxable.

What a jewelry reselling business needs in Augusta, GA

  1. LLC – limits personal liability, and an LLC under its exact name needs no extra DBA
  2. Trade Name (DBA) – lets the bank accept checks made out to your business name
  3. Federal tax ID number (EIN) – keeps your Social Security number off W-9 forms and supplier paperwork
  4. Sales and use tax number (Certificate of Registration) – required before the first taxable sale, including online, flea market and craft fair sales
  5. Form ST-5 Sales Tax Certificate of Exemption – covers goods you resell, not supplies you use up
  6. State employer ID – for state income tax withholding and unemployment insurance
  7. Augusta business license – renewed every year; inspectors may visit if you sell food or work with the public
  8. Secondhand dealer permit if buying used jewelry

Same permit, different names in other states

  • Arizona: the Transaction Privilege Tax (TPT) license. Arizona's TPT is a tax on the seller's privilege of doing business, not a tax on the buyer.
  • Texas: the Sales and Use Tax Permit. In Texas a customer's permit number alone is not a substitute for a signed resale certificate.
  • California: the seller's permit. A California resale certificate normally shows the buyer's seller's permit number; sellers accept it in good faith to skip tax.

Tip: Keep records of what you buy and from whom; resale of used jewelry usually comes with extra rules.
